1. Agreement to Terms
These Terms of Service (“Agreement”) constitute a legally binding agreement between African Crew Greetings (“we,” “us,” or “our”) and you (“you” or “Customer”).
By accessing our website, placing an order, or using our services, you agree to be bound by this Agreement. If you do not agree, you must not use our services.
2. Description of Service
African Crew Greetings provides custom-made digital video greetings created on demand by African dance crews based on customer-provided instructions.
Each order results in a personalized MP4 video created exclusively for the customer and delivered digitally.
3. Ordering Process
To place an order, you may be required to provide:
* your name and email address
* a personalized text message (for handwritten boards and shout-outs)
* uploaded photo(s), if selected
* a music choice (either selected by us or provided via YouTube link and timestamp)
* optional add-ons (e.g., birthday song, priority completion, vertical format)
You are responsible for ensuring that all submitted information is accurate and complete.
4. Payment
All prices are listed on our website and are payable in full at checkout.
By submitting payment information, you authorize African Crew Greetings and its payment processors to charge the applicable fees using your selected payment method.
All payments are processed through third-party providers such as Shopify Payments, Stripe, or PayPal. We do not store full payment details.
5. Delivery & Late Delivery Policy
* Standard delivery: typically within 1–3 business days
* Priority delivery: within 24 hours (if purchased)
Delivery times are estimates. However, the following policies apply to "Standard Delivery" orders:
A. Customer-Requested Refund for Delay:
If a Standard Delivery order is not delivered within 3 business days (excluding weekends and holidays) from the time of order confirmation, you may contact us to request a cancellation. In this specific case, you are entitled to a full refund, provided the video has not yet been sent to you.
B. Late Delivery Compensation:
If we deliver your video after the estimated timeframe but you have not requested a cancellation prior to delivery, we may, at our sole discretion, provide you with a 100% discount code for a future order as compensation. Acceptance of the delivered video constitutes satisfaction with the order, and no monetary refund will be issued in this scenario.
Exceptions: We are not responsible for delays caused by incorrect email addresses, spam folder filtering, incomplete order information, or Force Majeure events (e.g., internet outages, power failures, or natural disasters).
6. Artistic Interpretation & Limitations
By placing an order, you acknowledge and agree that:
* Performances are creative and may vary
* Video length typically averages 40–60 seconds
* Dancing style, energy, and presentation are subjective
* Perfect pronunciation in all languages cannot be guaranteed
* Minor variations do not constitute defects
No compensation or refunds will be provided for:
* performers “dancing too little” or “too much”
* personal dissatisfaction with style or performance
* perceived short length of the video
* pronunciation differences or accents
7. Music Selection Disclaimer
If you choose to provide your own music:
* only YouTube links are accepted
* a clear timestamp must be provided
African Crew Greetings does not guarantee the availability, audio quality, or suitability of third-party music links.
By submitting a music link, you confirm that you have the right to use that content and agree to hold African Crew Greetings harmless from any claims related to music usage.
8. Intellectual Property
Customer Content
You retain ownership of images and text you submit. By submitting content, you grant African Crew Greetings a non-exclusive, royalty-free license to use that content solely for the purpose of creating and delivering your video.
Video Content
All produced videos remain the intellectual property of African Crew Greetings.
You may share the video for personal or promotional use, but commercial reproduction, resale, or redistribution without written permission is prohibited.
By placing an order, you explicitly grant African Crew Greetings the right to publish, display, and use the created video on our social media channels (including but not limited to TikTok, Instagram, YouTube, and Facebook) and website for marketing and promotional purposes.
9. No Refunds & Cancellations
All videos are personalized and created on demand.
Once production has started, orders cannot be canceled or refunded, except as explicitly stated in Section 5 (Delivery & Late Delivery Policy) or in cases of technical defects.
10. Disclaimer of Warranties
Services are provided “as is” and “as available.”
To the maximum extent permitted by law, African Crew Greetings disclaims all warranties, express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, and non-infringement.
11. Limitation of Liability
African Crew Greetings shall not be liable for any indirect, incidental, special, or consequential damages arising from the use of our services.
Our total liability shall not exceed the amount paid for the specific order giving rise to the claim.
12. Privacy
We process personal data in accordance with our Privacy Policy, which forms part of this Agreement.
13. Governing Law & Dispute Resolution
This Agreement shall be governed by and interpreted under the laws of the United States, without regard to conflict-of-law principles.
Any disputes arising from this Agreement shall be resolved in English and through binding arbitration or competent courts, at our discretion.
14. Modifications
We may update these Terms of Service at any time.
Changes will be posted on our website, and continued use of the services constitutes acceptance of the updated terms.
